Hello..I am a stepmom and my husband is suppose to get his daughter every other weekend but she will not let me just pick her up...can she do this since we are married?

  • im sorry i dont quit understand youre question. Are you asking if she (as in the mom) can make it so you (the step mom) dont pick her up?

  • She can try. Your husband may want to go to court to amend the visitation order so you may pick her up and drop her off. There should be no reason why that can't happen unless she can prove you have many tickets, accidents, drug or criminal behavior...basically she has to prove the child is at risk in your care.

  • My ex and I have been in court for our children. His new wife tried to interject during the proceedings. My ex and I were both told that a step-parent has no legal right to ask questions or to interfere with the children by the judge. I hope this answer helps. Legally as a step-parent you have no rights as far as dealing with your husband's child. Therefore if her mom doesn't want you picking her up then that is her right.. if it is the daughter then that is totally another issue.

  • You can file for "Power of Attorney" for your husband so your word is as good as his.

  • Yes she is my stepdaughter we are suppose to get her every other weekend but she moved to Tallahassee as is court ordered to meet us, but doesn't. for the last six years we get to pick her up at 5pm on friday and drop her off on sunday. It is a six hour round trip. I try to help but when she is in a mood she says I can't pick her up

  • The six hour round trip is on Friday and Sunday so basically a 12 hour trip for spending one day with her...its sad

  • Okay so it's the step daughter not the ex wife saying you can't pick her up? Well then have your husband tell her he is unable to make the drive this time and it's you or nothing.

  • Sadly, I think she can say she doesn't want you picking her up. If she is older then she totally has a say. I know in our state kids are allowed to make their own decision when they turn 12. I also have a friend whose son started making them when he was 9. She went to court because of what was going on at the father's house. I'm not saying this is your situation I just wanted you to know.

    It is very hard, I think maybe you should try and talk with her. Maybe have her dad talk with her and find out why she doesn't want you picking her up.

  • She can deny you the right to pick the child up ...yes...however your DH needs to have the visitation order amended to include you as the child's transportation since you are married and you can pick up and drop off the child since the traveling is very extensive.
