can you file charges against a spouse youre divorcing?

I was seeing someone whose wife is a psychopath. Shes done everything from assaulting me to stealing money from his bank account. The police said since they are still legally married, he cant do a thing about it.

  • That's hilarious. Some police need more education.

Illegal behaviour doesn't become legal through marriage. While she can't 'steal' anything from him, as they are legally (still, things take a long time to change) him --owns what he owns, etc., assault is illegal no matter which spouse does the punching.

Just a tip, though, for you: people who are married to insane people are often just slightly less insane by contrast.

  • I'm gonna play devils advocate here...did you have anything to do with the reason they are getting a divorce?

  • He moved out in may of this year and asked me out in June. Supposedly they were on rocky terms six months prior to him moving out. His accounts, car, etc are in his name only.

  • he needs to change his account info then and block all cards and signature withdrawals except for himself or close that account and change banking institutions period!...if there are papers on file for a divorce he needs to report the illegal withdrawals to the court appointed judge...if he is trying to hide the accounts from her then he is actually also doing something illegal...if not then he has nothing to worry about.
