simple assault

Dh is being charged with simple assualt after beating up his nephews father. It could have been avoided but wasnt and he beat him pretty good. A lot of anger has built up and dh went a little wild. This guy is not a father to his son, has stolen from dh several times and has broke into our familys restaurant several times. Def not excusing anyone but just giving a litte background. What will happen to dh? Will he pay fines? Will he need anger management? Will he get probation? If you have any advice please let me know. TIA

  • this guy is an addict <<<< What else? It depends. If you guys have stuff on this guy, good stuff, he may drop charges. If the judge decides he dislikes this guy more then he dislikes what your DH did, then the judge may drop it, or just give your DH a slap on the wrist. Bring info to the court, don't just go in quiet.

  • It's really hard to say. If there are witnesses that can say they were actively fighting each other (not a beating), that could go a long way. My guess is that he will get a suspended sentence, probation, and some sort of fine - that's what happens here.

  • Also...DH does not have a record or a violent past. Just a lot of animosity built up

  • Was charges pressed against him? If the guy he beat up doesn't press charges nothing should happen. If he does its hard to say. IF he was put in the hospital that could get pretty bad.

  • Depends on all of the factors. He'll likely have anger management classes, he may have fines, he may have to pay medical bills. No way of knowing until then. Best thing you can do is be calm in the mean time.

  • There are no medical bills that we know of. Yes Stef the charges were filed against dh

    Thanks:) I went to a similar site for our state (NJ) and found that the fines are between 500-1000. Money that we dont need to spend but def could be worse. I was just really unsure of any other punishments

  • I just really feel bad for DH considering this guy is an addict loser. He was defending his family and was angry and now he might suffer. Just goes to show that ppl arent worth this bs
