What is the difference in unconstitutionality of a law that bans sam sex marriage and one that allows the rights of the unborn to be denied?

I'm starting to see a double standard here with the word "unconstitutional"....some argue their rights are being denied or discriminated against...well some can surely argue the same for the rights of the unborn who cannot speak for themselves and/or protest in West Hollywood?

  • well, first of all, you are discussing apples and oranges, because you are discussing two different constitutions.

    and a fetus is not granted personhood under the federal constitution.

    exactly. i would never have an abortion but i wouldn't tell someone else that they couldn't have one. i'm also not gay, but i'd never tell a gay couple that they couldn't get married. until these people start knocking on your door for either of these things, shut up!

  • I would think that gay and/or lesbian couples would take the defense of the unborn on the fact that unconstitutional laws are being made against BOTH of their rights...the right to marry and the right to life!?

  • Two people of the same sex who love each other and choose to get married do not affect ANYONE other than themselves. Their marriage does not inconvenience, endanger, damage, pose risk, frighten, hurt, or require anyone but themselves (and even then, no moreso than ANY other marriage). A same-sex couple has exactly as much impact on a heterosexual person as a heterosexual marriage does - maybe less, since the same-sex couple is significantly less likely to include a woman who will steal another man's husband or a man who will sleep with another man's wife.

    THAT is the difference. It would be more accurate to compare forced childbearing to forced organ donation which, thankfully, are BOTH illegal right now.

  • Continued - besides, the real issue here is whether or not Joe Plumber has any right whatsoever to decide who Susan, Matt, and Jane can marry or whether or not Susan and Jane have babies.

    He has NO right. NONE. THAT is the issue.
