LAWSUIT?

A relative in my family is blind and can only see 10%. He lives in apartments and recently went outside and slipped on snow & ice right outside the apartment. He was trying to cover his head with arm so ended up fracturing his entire elbow! What are the lawsuit possibilities for this?

  • I think it depends on what the rules for the apartment are. If he is responsible for clearing out snow and ice in front of his apartment then the apartment owners are not responsible for it.

  • Its not a condo, the rules are the apartment cleans snow and the apartment cuts the lawn.....

  • Its your typical slip and fall case... they should pay for medical damages, but nothing else because there is most likely no PERMANENT damage done.

  • It could take years for a lawsuit to go though and once it does he would be broke from attorney fees. Most states he would be responsible for anything obsturcting his walkway out side his apartment. best bet would be to go on Michigans state web site and research possibilities. Tenant and landlord laws. also have him look on the lease he signed ans see what it says. In legal terms the snow would be called "An Act Of God" .. good luck to him and hope he gets bette asap!

  • In Michigan people are responsible for clearing now and ice if they own the property. The apartment complex is responsible for this. Neglecting this property including the "public" sidewalk that runs the length of the property can result in personal injury lawsuit.
