  • Who has legal custody? That would be a big determining factor. If you have custody then no he can't but if it is joint I believe he can. Check with an attorney you should be able to find one who will talk to you without a consultation fee.

  • What does your custody court order say. If it doesn't say he can't, he can.

  • Question doens't make sense. You have custody? Then yes, he can leave the state without your DD and without your permission. He likely can't leave with your DD without your permission. See the wording issue making it confusing?

  • my court order says my ex can't leave the state with my son without strict permission given weeks before. so i would assume yours couldn't either, especially if you are the "primary".....
