Do you need a lawyer to get a divorce?

  • You can file your own - there are a lot of places on line you can find the paperwork (be sure to get the correct ones for your county/state). You can't (or shouldn't, depending on the jurisdiction) file your own if there is anything contested in the divorce, and there are some states that don't allow a "pro se" divorce if there are any sort of custody issues. To be safe, contact a local legal aid group and they can steer you in the right direction.

  • In most states you can get a dissolution of marriage without an attorney IF there are no children involved and you do not own real estate. In those cases you do have to hire an attorney.
