What happens when you put a couple in your last will to take care of your child in case you die, BUT later they split up?

Of course you can always change it, but imagine something happens before you do. Or you just forget about it.

  • Who would YOU want to have custoday in that scenario? And, would that ONE person be willing and able to do it? You need to have those discussions now and it can be stipulated in the will in according with those wishes.

  • i think it would be like if they had the child together they would split custody or decide that amongst themselves but if it were me id make sure they knew the child was to go to the member of the couple who is my family, if its a relative.
