So would churches have lost their tax exempt status if prop 8 had NOT passed?

Referring to the question below about the gay wedding and church losing its tax emempt status...... would churches in CA lose their tax exempt status as well if prop 8 had NOT passed.

I thought that they wouldn't?

The commercials said it was a LIE and they would NOT lose their tax exempt status?

So what's true?

  • yes! that's why the mormon church has also lost it's tax exempt status.

  • and BTW if the churches in CA are part of a national "chain" such as having churches in other states where it is legal, they will still lose their tax exempt status if they are in CA... like said above with the mormon church which is Utah based since that's where their HQ is, but the marriages are legal in other states, they lost their status.

  • they won't loose it as long as they don't violate teh rules that govern it

    "Section 501(c)(3) of US Code Title 26, which governs tax-exempt organizations, reads (emphasis added):

    (3) Corporations, and any community chest, fund, or foundation, organized and operated exclusively for religious, charitable, scientific, testing for public safety, literary, or educational purposes, or to foster national or international amateur sports competition (but only if no part of its activities involve the provision of athletic facilities or equipment), or for the prevention of cruelty to children or animals, no part of the net earnings of which inures to the benefit of any private shareholder or individual, no substantial part of the activities of which is carrying on propaganda, or otherwise attempting, to influence legislation .. continues
