Can you still rent a house if you claim bancuptcy?

My Dh and I were victims of a mortgage scam. We sold our house to a company and we found out three months ago they quit making thier payments back in March. The mortgage company won't let us back into the house. So we have two mortgages (one house one vacant land)....currently we are renting but we were looking for a more "long" term rental and was wondering if claiming bancruptcy would effect us getting into a new rental? Thanks for any help.

  • probably if the rental is owned by a company rahter than an individual.....a company is much more likely to do a credit check than an individual....but a credit check might be done either way

  • It really depends. We filed chapter 13 under the new law and we are stuck for quite some time. We cannot get another mortgage until at least 2-3 years after the discharge of the bankruptcy. We also cannot try to sell our home and go to a rental as many rentals, for one wont accept us and two are actually more expensive than our current mortgage payment. A couple yrs ago my dh lost his job. We fought for 2 years to save everything before we finally declared bankruptcy but it still hurts us as we can't go looking for a cheaper home bc of this so we are still kinda stuck between a rock and a hard place.
