can a parent get custody although the other parent doesnt agree? and if they dont agree, then it becomes joint custody?

  • You'll have to have good reasons for wanting sole custody. If the child is not safe with the other parent then it doesn't matter whether that parent agrees or not.

  • The other doesn't have to agree and they probably don't if it's going to court. If they agreed they would just sign papers. It can be joint if that is what the Judge decides.

  • there are different types of custody too, like you can have sole physical custody, but joint custody regarding decisions with school, doctors, ect.
