  • Depends, but I have no case to refer to so I can't specify. It would be hard to have a case these days without enough information (including DNA) to convict someone and put them to death so it's doubtful it would be an issue these days.

  • Yes. There are those out there good enough to commit a crime but leave no DNA. If you murder someone and the gun is destroyed where is the DNA?
