Court papers for rent i've already paid!

I just got court papers. They were not served, they were put in my door. It states i owe $975, $425 For january, $550 For february. I paid the full 550 for january and i only owe 440 for february. I have receipts. I also have pictures of all the damages of this house they fail to fix and there is no Certificate of Occupancy on the house which is needed to make this place livable. I moved in the first of Jan and they agreed to fix it by Jan 10th. They didn't so i've made arrangements to move the end of this month. What can court do since the landlord has lied and is renting a non livable place?

  • First thing, since you were NOT served via Certified Mail or Sheriff, you DID not sign for them, so that is RED FLAG #1. You may however be required to pay the $440, if thats what the lease said. (sorry) Im assuming the landlord did not put in writing what he claimed that he was going to fix. if you need more answers, contact me:)

  • I agree with both of the answers above. And if they DO sue you and you get a subpeona by an officer (official subpeona) then ask to countersue. Make sure you have evidence of EVERYTHING. Also, if those papers amke you uncomfortable take them to the courthouse and make sure they are real. Many things can be made on computers to look legitamate these days sadly. :(
