Divorce and child custody?

Is it done in the same court? Or is it in separate courts?

  • I guess it depends on state and case.

My s/o's divorce, custody and child support was all rolled into one. Granted the custody and support where done way before the divorce was final it was all one thing.

Plus, in our state if child support needs to be changed it has to wait 3 years til after the first amount was set at. Of course unless custody changes too. After the divorce either parent can file to change custody at any time.

  • It is done in the same court. Child custody is a facet of divorce.

  • Depends on your state. My divorce was done seperately from child custody. Custody was actually decided way before my divorce was final.

  • Child custody and child support are part of the divorce process and paperwork?
