If a husband signs it does that mean he is automatically the dad?

  • as far as I remember when my kids were born, he didn't even have to sign it because your husband is automatically presumed the dad. If he isn't then the only way to go around that is to lie and say your single.

  • It means he is assuming legal responsibility for the child and acknowledging that he is the biological father, even if he isn't.

  • Depends on the state in NC whoever signs the BC is considered the Dad (if the parents aren't married)
    If they are married the husband is automatically considered the father.

  • If a wife gives birth the husband is the presumed father and is automatically put on the birth certificate. There is no signing of anything when they bring the paperwork to you your name and hubby's name is already on there. My hubby was in Iraq and he was still on the BC.

  • When someone signs the birth cirtificate they are acknowledging they are are the parent of this child. I think that it would depend on the state you live in as far as what rights this entitles a person who signs as the father. But I do know that once a person's name is on the certificate this means until other wise specified in family court by a court order, that person has equal rights to the child. That means they have the right to take that child anywhere, get medical treatment, make decisions, and even take that child to live away from the other parent. Again, until a judge issues a decision in court, both parties on a certificate have equal rights. I would check your state laws though. Some states may consider the certificate as a statement that you believe you are the biological parent. Signing while knowing it is not true could be illegal.

  • NOT SURE IN OTHER STATES BUT IN MAINE, IF YOU WERE MARRIED @ THE TIME OF CONCEPTION ( EVEN IF SEPERATED) HE IS THE LEGAL DAD, SIGNED OR NOT. IF YOU WERE NOT MARRIED AT THE CONCEPTION HE CAN SIGN BUT IF HE IS NOT THE "REAL" FATHER THE OTHER GUY CAN HV TESTING DONE AND LEGALLY HAVE HIS NAME REMOVED FROM THE B/C AND HIS OWN LEGALLY PUT ON
