Child support question

is it true that the oldest ones always come first or is it just who has the child support order in effect first?

  • It's who files first, not who is born first.

  • I believe it is the child support order in effect first - in Florida that is how it is I'm fairly sure. In Florida there is a set formula regardless of how many kids - you plug the income in of both parents and you get an amount - the judge has no discretion to order more or less.

  • Their reasoning is that they don't want to take away from an existing order, and at least in Michigan, they give parents credit for how much they spend supporting other children when future child support amounts are calculated.
