  • I'd think it'd be similar to aggravated assault, where physical harm was done, like bruising.

  • Any circumstances surrounding the commission of a crime that increase its seriousness or add to its injurious consequences.

Such circumstances are not essential elements of the crime but go above and beyond them. The aggravation of a crime is usually a result of intentional actions of the perpetrator. Such crimes are punished more severely than the crime itself. One of the most common crimes that is caused by aggravation is aggravated assault.

  • aggravated child molestation, is when the child is physically injured or sodomized.

  • Well, sodomized would certainly be physically injured. It can also be the charge for a very young child. We once had a case where a mother left her 6 month old daughter with her crack head boyfriend and he penetrated her. It was one of the worst cases I ever dealt with.

This was the one that turned the tide to homicidal for me. I could have tortured that man to death.
