  • Go to the post lawyers(forgot what they are called). They can tell you everything.

I know that if your separate, you are suppose to get his BAH tell the divorce. Legal separation I don't really know of. He might be yanking your chain. Talk to his 1Sgt to he or she might be able to help some.

  • Yes its true. Call JAG. That is whom will tell you what is important for you on this. CALL THEM ASAP. BECAUSE if he has called them before you and set up an appt, then they are going to advise him and not you. They do the first come, first serve thing.

  • Had this happen to me with my ex, so I know so I know what I am talking about. He is supposed to give you BAH yes, BUT its about 3/4 of what the total amount is. This is to cover both you and your child. Child Support does not come into effect till you are legally divorced.

  • Legal separation is a way of getting it in writing so that if he decides to reneg on this, you have it in writing and can take it to his command. If you have more questions PM me. Like I said, been there, done that.

  • ALSO, if you get a legal separation and he informs housing then you (him too) will have to clear housing. Its just part of the process. If you do plan on a divorce also check out your states separation requirements. I know that for each state it is different and some do require a legal separation in effect to grant a divorce. That said, document, document, document. Seriously, everything documented will help you in the long run. Good luck!
