would it be automatic that the child goes to another family member or does the mother still get the child?
i want the aunt in my story to try to get custody of the child but the mother is going to live after she trys to commit suicide. The aunt fails and the mother will get a restraining order and the aunt ends up getting jail time (maybe).
Getting a parent deemed as unfit depends on the judge, CPS in the area, and the actions of the mom. It's really hard to lose custody of your children CPS workers seem really reluctant to suggest to the judge that a parent should lose custody. If the mom shows any attempt to work on her parenting skills this works in her favor. Also the lawyer the aunt chooses matters a lot, some will really fight for their client to receive at least temporary custody and some don't put in much effort at all.

No it's not automatic. The aunt needs to go to court and seek custody.
