"My 9-year-old was riding her bike yesterday and accidentally hit the neighbor's parked car. She was honest about it and told the neighbor what happened. We were told not to worry about it and the other kids in the neighborhood had also damaged her car (but took off instead of telling the truth) so she would have the scratch fixed when she had the rest done. A few minutes ago she came over to tell me she is filing a police report. Now I'm worried. What can they do?"
Mothers in response to southen's post pretty much said everything that came to mind for me: sounds like insurance purposes, be careful not to get blamed for any pre-existing damage, and was your daughter wearing a helmet?
Anything to add here? Any experience with this kind of thing? Do you think the mom can be penalized beyond paying for damage?
From my past experience, most insurance claims for damage or lost / stolen items you have to file a police report about the damage and / or item and give the report number to the insurance company. I would possible have the neighbor document something in writing about which scratch came from my child and what she commented to you about " dont worry about it" for your records.
Did she take a pix showing which was daughters scratch?
I would call insurance co., and find out if covered by Home owners or Auto!

If the neighbor is dishonest, then she could end paying for all the damage. Also, if the neighbor pushes the police could investigate as if she was not watching her daughter. It all comes down to how much of a brat the neighbor wants to be. There is alot that could happen.
I don't think the police will do anything to your daughter, it was an accident. I wouldn't trust the neighbor though. All she had to do was make an insurance claim and bring the car to a body shop to get fixed. No police report necessary. My car was keyed twice and I didn't need a police report, called the insurance and went to the body shop and it was fixed and paid for in a week.
sorry i dont think that is considered under uninsured motorist lol last i checked you dont have to have insurance for your kid's bikes
Most insurance claims or accidents of this nature will require a police report. The parent if proven the child did this will usually be held responsible but it would be a civil case not criminal. I don't see any laws broken here but mom/or insurance company will be held responsible for repair to the extent of what your neighbor can prove.
Would be intresting to know if the neighbor actually finger pointed the kid in the police report, or just filed the report as an unknown cause. If she implicated the child, i'm sure the police would have atleast interviewed the mother and possibly child.
