When can I stop using a car seat?

My son just turned 6 last week. He is 50 lbs and I can't remember his height...46 inches? OMG...I'm so bad! lol I'lll know next week when I take him for his yearly checkup. Anyways, he's begging to get out of his car seat and I'm not sure what the law is as far as this is concerned. I'm fairly sure it has to do with height/weight and age. Can anyone help me out? I don't know if laws very state to state...we're in NY. Thanks for the help!

  • In MD and VA I know they just changed the law to 8 years old. (They can ride in a school bus without a seat belt but have to have a booster seat in the car!) Sorry, I do not know about new york though.

  • IL the law is also 8, but the child also has to to be 4 ft 9 ins.

  • im in sc and it goes by your weight i think its 60 pounds but my stepson is 7 and the doctor said he could get out of his so he hasnt been in one for a while

    It states that children 4, 5, and 6 MUST ride in child restraint systems.

    That to me must mean car seat/booster seat. Mine are in a BOOSTER seat that allows them to buckle up like a "bigger" kid! They are actually in this booster seat (see the link that follows): http://www.toysrus.com/product/index.jsp?productId=2861774  

    I don't know what you are using now, but perhaps an upgrade to an "bigger" kid booster seat may make him fell more "grown up".... Espeically see the booster seats allow them to use the seat belt like big kids!!

  • No, he isn't big enough. Sorry..

    Here is the test to see when a child is ready to ride without a booster seat..

    The 5-Step Test.

    1. Does the child sit all the way back against the auto seat?
    2. Do the child's knees bend comfortably at the edge of the auto seat?
    3. Does the belt cross the shoulder between the neck and arm?
    4. Is the lap belt as low as possible, touching the thighs?
    5. Can the child stay seated like this for the whole trip?

    If you answered "no" to any of these questions, your child needs a booster seat to make both the shoulder belt and the lap belt fit right for the best crash protection. Your child will be more comfortable, too!

    The back seat is the safest part of the car for all passengers. Recent research shows that children should ride in the back seat until they reach age 15.

  • Technically for your state he is able to ride without a car seat but I would never recommend a 6 year old to be with out a car seat.

  • Legaly he can be in just a booster seat but it is safer for him to travel in a car seat. A seatbelt is only a 3pt harness, a car seat is a 5pt harness. The more pts on a harness the safer it is. And HeyMommy02 has it right, he cannot ride with out a booster until you can answer yes to all of thoose questions.

  • depends on your state laws. my 6 year old is 51" and 55 lbs and in a HBB with SIP.
