If my husband wants a divorce, do I have to agree to it?

  • Well I would think you would need to speak with an attorney in your state to be sure. I would think that he can divorce you without you agreeing to it. By notices in the newspaper and certified letters sent to you and things like that. He can petition you for a divorce and you will eventually have to meet in court I read. Also, my mom divorced my stepdad and he wasnt agreeing they had NO kids. And after 6 months it was granted! But he will still have to pay child support and things like that for the kids and possibly for you as well. I googled this for ya:
    Do you want a fault divorce or a no-fault. If you want a fault divorce, you can use adultery (if true) or constructive desertion in most every state. If you want no fault, it generally just requires a longer period of separation for a contested divorce than an uncontested (usually 2 years vs 1 year).

  • you do not have to agree to a divorce.. he can still get one. But there is no way that he can leave you and his children homeless. Do not leave that house or he can get you for abandonment (depending on what state you live in). Get a lawyer and get one quick. I'm going through it myself. Good luck!

  • I think it depends on the state you live in. Here in MI both parties do NOT have to agree. Good luck

  • oh and ps those who file for divorce first normally has a leg up in court.

  • You don't have to agree to a divorce, but they can sue you for one if you don't. Which means more money for the attorneys, and less money for you guys.

  • Like everyone said before he can divorce you without you agree to it. I know you might be going through very emotional times, but please have someone family member or close friend help you with your finances. Open a checking account under your own name, pull a credit report at all three agencies (most states are l free a year some even 2) if he is an auth. user on one of your credit cards take him off, find out if your house has been being pay for, check bankstatement to see if large amount of money have be transfer out or w/d. Yes it alot that I suggest someone to help or just do it for you. Unfortunately, I learned the hard way. good luck
