Dh contacted the IRS today. She told us to file our taxes claiming the one child like we are supposed to. She said both parties would be audited and which ever party claimed the child and should not will be responsible for paying the IRS back and penalties.
When dh called to tell her the IRS said she could have her taxes reprepared to solve this problem. Her response was I don't have anything the IRS can take IRS can take from me so I don't care!

Maybe she will get arrested? Or somehow pay the price so she can learn her lesson.

No, but her EIC, and all future returns will be watched closely. My ex has been banned from ever claiming EIC.

That's the plan, I just hope the IRS gives us a portion of our taxes back. I need to get my brakes down on my van. Front and back and I just don't have the money to do it.

Does she not have a checking account? I used to process levies when I worked at the bank. The IRS will clean out her checking account, and THEN she will be informed about it. And the banks aren't inclined to waive the bounced check fees either.
