Withholding address question

If a parent refuses to give an address to try to not get acknowledgment forms or summons...what does one do? If we have sheriff deliver the summons will they just find her or what?

No the sheriff will only go to the address you give them.

This is why bm was able to keep SO away from SS formfive years, she refused to tell him where she lived, and moved every 6 mos so he couldn't catch up with her.

We turned it around on her after we did find her, because she was trying to file a counter motion for sole custody and did not have our address, she was unable to file because we had moved and didn't give her our new address ( we had already told her she. Ould have it when we went to court for our motion). She didn't care much for her own medicine.

So if we don't have an address for her, we can't file for a modification??

You have to have an address for the other party to be served. Try "zaba people search". It's completely free.

Also, if there is no known address, ask the court about notification by publication. Most all do allow this if there is not an address for notifying the other party about a court date and such.

Another one is if you or DH have numbers for family members, call them and ask if they have an updated address. I'd try that before the publication part.

Thanks. We are going to go talk to the court and sheriffs office on Monday and try contacting her mom and ex bf that she just had a falling out with. It's just frustrating. The only thing changing is her weekend visits so we dont understand why she won't give us her address for the modification. We just want it documented since her word in the past hasn't mean much

Our lawyer told us they had ways of finding her it would just take longer. Granted, it's not like she was refusing to give us the address, we just did not know the address and DH did not want to ask and make her suspicious.

 Could not being able to find the other parent be grounds for an abandonment charge?
