Child Support

So...would it be wrong to ask for child support?

Quick Run down

* DH and BM have 50/50 parenting. One week on one week off

* BM hasn't paid for supply fees for this past school year 

* We take kids to all appts and pay for all activities/medical/school/etc. 

* She is a server but makes pretty good money

* She can pay for cable, a cell phone and cigarettes but not expenses for the kids...


Would it be terrible to go for support? We've asked for more custody in the past, but she goes into this martyred mother mode and declares how much she loves her kids and wouldn't be without them...Yet we do all the work...It's just frustrating.

On paper yes. She's been living with her bf for 4 years now and he contributes to her household. She also told us she couldn't pay her half for both DS to do cheerleading but then bought both of them a Nintendo DS this past week.

If you all have them 50/50 then no you shouldn't ask for support. It's not like you guys have them all the time

If she were completely single, or her bf didn't live with her I wouldn't even think about asking for childsupport because I know that being a single mom can be hard.

Be careful.  Going for CS may end with him PAYING CS.  It will be hard to prove her actual income.  If she isn't doing an honest reporting on her wages then it could look like a HUGE income disparity between her earnings and your DH earnings and he will end up paying her CS plus all the stuff you just said you pay for the kids.

I don't think 50/50 custody should have CS.

But shouldn't she pay half for supply fees for school, take them to the dr, or do something? We do all of that.

It shouldn't matter if she is single or not.  Her BF is not responsible for her kids.

Yes she should if it falls on her time, in my opinion
