TACOMA, Wash. - A man accused of child sex crimes is being allowed to watch child pornography inside the Pierce County Jail in Tacoma, Wash.

 

    1. Marc Gilbert, 50, is accused of sexually assaulting young boys and videotaping the abuse. Because he's chosen to act as his own attorney, he has unlimited access to that pornographic footage, which is considered evidence in the case.

"Make no mistake - I don't like it," Pierce County Sheriff Paul Pastor told komonews.com. "But it is not my choice whether to do it or not to do it. There's no question that I don't like it. There's no question that this makes me grind my teeth."

Gilbert, who appears in several of the videos, was charged with child rape, child molestation and sexual exploitation of a minor in 2007, after the brother of two alleged victims called police, ABC News reported.

Investigators seized from Gilbert's possession more than 100 DVDs containing 28 hours of pornographic footage, komonews.com reported.

Witnesses told ABC News that Gilbert, 50, would give the boys alcohol and spank their bare buttocks. In several cases, prosecutors told ABC, Gilbert allegedly engaged the teens in masturbation, oral sex and anal sex.

The prosecutor and the sheriff said a legal loophole has allowed Gilbert access to the porn while in jail, and that the state Supreme Court has affirmed his right.

"We don't like it. We don't want to do it, but we have to follow the law. The fix here is to change the law," Pierce County Prosecutor Mark Lindquist told komonews.com.

I really wonder how they are going to try to close that loophole.

They are going to the state legislatures and change the law so it more closely mirrors the federal law which states that prosecutors do not have to provide contraband evidence to criminals who are representing themselves.

There should be no loop holes for sex offenders , I am so tired of  system protecting the guilty more then  the victims.!

Huh, I didn't know about that federal law. That's actually a good one I think. I hope they can and write it so there are no grandfather clauses.

 How freakin' ridiculous! He can't be the first that has found this loophole. I wonder why it hasn't been overridden before?!?

how does that saying go? Anyone who represents themselves in court, has a fool for a lawyer........that's probably a bit off.........lol

the truth is the guy is mentally ill........only mentally imbalanced people will represent themselves (in most cases) they feel no one can do a better job then they can, in this case he wins back his porn too.........it's ok, he will lose his own case..........and no more porn for him, ever............is it right? Hell no, but until they start changing the laws on mental illness, this is the way the law is written........if they deem him mentally ill, he won't be going to jail, he'll be going to an institute and the institute will release him when they feel he is safe enough to leave...........so for them to put him in jail for a long time they can't do anything about this......
