I think it's hard for some children to adjust to being in Kindergarten. There are all kinds of new rules to follow. He may be talking a lot and walking around but it could be that he is still adjusting. He sounds like he is really smart. Have you talked to your son about this? I would have a discussion with him about staying in his seat and not talking to the other kids. I would also ask the teacher why they are not given breaks. Usually they get a recess in the morning so they can go run around. If nothing changes after all of that, maybe you could look into the whole adhd thing a little more.
Special Ed or a teacher aid doesn't mean slow or stupid. Maybe the suggestion of a teacher aid is to help keep him on task and/or focused? Since you have said you noticed that he doesn't focus well. I would hold off on doing all that though until he's been in school a bit longer. Let him adjust to what is expected of him and see how it goes from there. Also remember that just because he might need a little assistance now that doesn't mean he always will. My middle sister recieved special ed services in elmentary school. By the time she was in middle school she no longer needed them and graduated with a regular education diploma.
It might not be that he is slow if he has ADHD. Is there an ADHD specialist in your area where you can take him to get him tested. ADHD can make it so you can't do your work because your mind is all over the place. I have one at home I know. He has to have his meds. or he does awful at school.
