My sis had her 1st child support hearing last week and is a bit upset. BD was ordered to pay only $33 a week. The judge asked my sis to provide all her proof of income but never once asked for BD's all he did was ask what he made hourly. He makes less hourly but also works 40+ hrs a week when my sis works 25hrs a week so he brings in way more than her. She has her own apartment, has her own car, her own bills... BD lives with mom and she pays for everything for him except for what he collects in PA since he qualifies for being legally married (his wife and him haven't been together in 2yrs just too lazy to file for divorce). He also has no license or vehicle.. he's a complete bum! Judge told him he doesn't have to provide anymore than the $33 a week and if he does it'll be on him and considered a gift. He also gets to claim their son every other yr on taxes.

Is there anything my sis can do about this? She obviously got screwed completely!

Hire a lawyer, or go to legal aid.
File for a child support modification. In those forms both parents have to provide all the income and proof

she can contest it, but it'll just be more money out of her pocket.

actually, any lawyer will suggest waiting a year before changing the order, unless the change of income was dramatic.

PLUS i highly doubt they didn't ask him for his proof of income, sounds like bull to me.

The judge cannot go on overtime. I know trust me.

What is the custody arrangment? Judges often go by that as well, along with child care, if she is only working 25 hrs a week then child support will be less because of less day care and so on.

my dh and i got screwed in court too

i literally think the court system is no longer used for justice for the innocent and the victimized

but at least your story might serve as a lesson for others...if you're thinking your partner is in some ways a loser....really think about that and his qualities and character before you leave yourself open to possibly having a child with him

She went and my mom and cousin went with her as support and they all tell the same story. He did not have to show any proof of income and they were seriously irate about it. Not bull. Its a fact.

I would agree with this accept they weren't together when she got pregnant. They were high school sweethearts and were together for 8 yrs . He cheated on her, left her, and married the person he cheated with. He then tried to go back to my sis and she turned him down. One day he asked to talk with her and he came on a day she was upset. They talked and she made the bad decision of sleeping with him once. They even used a condom. It never happened again and she didn't pursue any relationship with him because she knows the kind of guy he is.

The bull really depends....my son lives in FL and the judge never made the mother prove how much she makes, just took her word. My son hasn't had a reliable job in 3 years because of where he lives. The judge just threw an amt out that he has to pay, which is way above what he makes. The mother also got protective orders, even there was no proof that he ever did anything to harm her (and no, he never did). The mother has kept his child from him for almost 3 years now and the court could care less. He has filed for child support reduction every year and has been turned down. The court system where he lives is very screwed up!!

I believe it. The same thing happened to me. I was in court, ex was on the phone, the judge said he didn't receive his papers and asked my ex what he made an hour. It was bs. The worst part was that half of his income is commission. That was not figured in. It was at a later court date, when his yearly was divided.
