in some states you can sue the person your husband/wife was having an affair with. So lets say you find out your man (or woman) has been messing around on you for a year and decided to leave you for her. You stumbled across evidence of the year long affair and that she knew abt you the entire time. when you confronted him he chose to leave you. now you have evidence...would you take her to court and sue her or let it go? do you think this should even be an option?

As of January 2008, the only states in the United States that allow alienation of affection lawsuits are: Hawaii, Illinois, Mississippi, New Mexico, North Carolina, South Dakota, and Utah.

i wanted to add that my husband isn't really cheating on me. this is just a hypothetical thing. i think some thought i was really going through this

Sue for everything he/she has!!! If they did that in NY there would be less ass kicking & domestic violence.

i would go after HIM not her. he was the one in the marriage , not her. i cannot even fathom someone suing the other woman. has this country gone mad with being sue happy?

I'd sue her ass. I'd already get child support and alimony from him so I may as well go after the whore too, especially if she knew he was married.

this is actually an old thing. most states have done away with it because it has its roots in the archaic thought that women were men's property and so this was how men could sue other men for taking their 'property'. now though women are using it to the full advantage by going against mistresses in the states that still allow it
