nurse gave my son the wrong shots! should i sue? edit

Took my son to his well baby check up. They wanted to do vaccinations, I said no because he was getting over summer cold. I went to the restroom, came back and they were in the middle of doing them! Wtf I am so upset! They were not even apologizing or anything, actually they were pretty rude about the whole thing!

Edit to add, he is almost 1 yr

Edit! His dad was with him but 1- he said he didnt give permission, they just told him to put ds on the table so he did, 2- he doesn't have medical decision making, only I do so he can't give permission, 3- I would think a Dr office would be safe! They were only supposed to give us his height and weight chart and we were about to leave

Don't your babys fathers go to Dr appointments too?

Edit! Some of you are crazy. Ds father is not a decision maker. He will just go along with whatever anyone says. Thats why we are not together because he is stupid! he just said "I don't know she said to put him up there and I thought it was fine. I thought that she knew what she was doing." He only has visitation, I have sole legal and physical.

I have never had to sign for vaccines. I don't know if that's the law but either way I have never had to!

 I dont sign for shots at my kids pedi.

His father was with him but he didn't know they were doing it, besides he can't have medical say either way due to custody

He saw the nurse come in with the syringe and didn't tell her not to before she gave him the shot?

Someone signed the consent form.

In Ohio they can. It isn't a medical procedure. Our patients/parents don't have to sign paperwork to receive shots.

So nobody believes your story because only an idiot would leave their baby alone in a doctors office so you add a fictional father who has no authority to make decisions for his child and doesn't have the wit to tell a nurse not to give a shot when he sees syringes. Can't wait to see the next variation when people call you on that.

 There's alot about this story that doesn't add up. You left your child in a doctor's office to go to the bathroom. You made it sound like he was alone and it was in the middle of the appt, then people call you out on why you would do that and you change your story to it was the end of the appt and his father was in there. And then you say the father of the child has no say in medical decisions. Ok, why would he not have a say in medical decisions and still be there with you? I have a friend who had the father of her child removed from making medical decisions and I can tell you that he sure wasn't going to follow her around like a puppy dog after that. They can not give your child shots without you signing for them, and if the father of your child did put that baby up on the table then he was stupid to listen to them. Why wouldn't he ask "why do you want me to put the baby up there"? Or why not say "We better wait for his or her mom to get back from the bathroom because I can't make decisions about medical care"? Something smells fishy here

That's a risk for them. If the child has a reaction, without you signing, you can sue. You can say you weren't told of the risks. Signing prevents them from being sued.
The dr that is, you can never sue the manufacturer. They're exempt by federal law for vax reactions. You can sue for med reactions, though. Just not vaxes. Drs, are liable, though.
