If the fathers name isn't on the birth certificate, what rights does he have legally? What would he have to do to get visitation or custody?

He would have to get a DNA test, first and foremost.

Without a custody agreement in place he has no rights. He can however file for custody and get a DNA test through the courts.

If the mom doesn't want him on the bc, and isn't asking for help can a paternity test be forced? He had an opportunity when baby was born. He was present and was told he would have to have one before he signed the bc. In our state for unmarried couples the baby automatically goes to mom and custody and visitation is worked out voluntarily or in court. Now they require a paternity test before the father signs when baby is born, but they don't force you, they tell you and if you don't ask about it then your out of luck. He was there, he knew, he conveniently forgot

none...he would need to petition the courts for a dna test
