I think that is kind of stupid. A lot of dogs do great in an apartment with proper exercise. Some shelters around here don't care if you live in an apartment as long as your landlord is alright with it. Good luck finding a dog.

Get one from Craigslist - you're saving a dog from going to the shelter :)

Private rescues usually have higher/stricter standards than shelters do.

Check the classifieds in the newspaper, there are ads for puppies in there constantly. But DO YOUR RESEARCH about breeds first. Find a small, quiet laid back breed that will do well in an apartment. In other words, do NOT get something like a Jack Russell that is super hyper and crazy, LOL.

They also do home visits and make decisions based on the situation and dog.

I have worked with private rescues for many years and this is how we have always been.

If I go that route, it'll be  a Dachshund. I've had one before in an apartment situation, and he was great! Plus, I know what I'm getting into with them
