Yes. It should be illegal. Marriage is a legally binding contract between two people. There should absolutely be legal consequences for breaking that contract.

No. It's not a crime. Just like you can't be arrested for having butt sex or for having sex out of marriage.

But if someone breaks a contract (like a lease) they can't be arrested. It's just a contract, not law.

Actually in most states infidelity is still against the law in the books. It's just not followed up on.
