Why would you ask this?  I can see asking as a potential employer whether or not someone can legally work for you but in any other context I don't see why it concerns you and I think it would be really rude to make any assumptions about someones life.

Were you planning on hiring this person?  If not, I can't think of any other non-rude reason for asking.

Hmmm...  I think it's crude to ask and I would assume your intentions on knowing to be bad ones.
