My husband and I have 2 kids and I'm currently pregnant. We've always had a rocky relationship filled with ups and downs. I admit I am a bitch but my husband has hit me, choked me to the point of passing out, drug me by my hair, spits in my face...I know it sounds stupid that I stay but I really have no where to go with my kids and don't want anyone to know whats going on. With all this going on in our relationship, the other night he asked me to have sex, I said no cause I was tired. I woke up about 30 minutes later and he was inside me. I immeadiatly pulled away and told him I said "NO" but the fact that he did it to me while I was asleep scared me and made me feel extremely violated! Now he is my legal husband so I wanted to know from a legal stand point, is this okay?

No it's not okay, but he'll continue because he apparently knows he's got you trapped. I'd be heading to a DV shelter before you end up dead.

From a legal standpoint (NOT opinions, this is the LAW), he raped you. If ANYONE, even your husband, has sex with you without your consent, it's rape. You were sleeping, unable to give consent, and he had sex with your unconscious body. That's legally rape.

No - that is rape.

Married or not, consent is needed for sex or it is rape.

For your safety and for your kids sake, please call a local domestic violence center. You need to make a safety plan and get somewhere safe.
