I have court for child support on friday. It will be the first time in a new county. we have had the same order for 6 years. x has not payed for over 6 months. he owes over 3,000. What should I expect at court? do i have any legal rights to demand he pay something asap? he is working under the table.
They will make a new order, set up an arrears amount for the $3000 and add that to the order. He should have been informed with an amount that he needs to bring with him to court to keep his ass out of jail that day.
You can not demand anything. He will be allowed to tell them why he hasnt paid possibly ask for a reduction and told he needs to pay a certain amount by a certain time or get a warrant out or lose his license. If hes only stopped paying for 6 months out of 6 years they will prolly not throw him in jail this time.
They will probably drop a contempt charge on him, they can take his drivers license, and possibly jail time if the judge is a deadbeat hater.
But if he's working under the table, don't expect to see a dime. Even if you can prove he's under the table, they can't forcibly take shit from him. He has to be getting a check under his social for them to really enforce payment. But everytime he files taxes, you'll get whatever return he thought he was getting back. He won't be able to get a concealed carry permit, or a passport.
