What's the chance of him having herpes?

My DH and I separated for two years. During that time he slept with another female who has an awful reputation during a one night stand.
Since then he and I have gotten back together. I asked him if they used protection, he informed me no but she had her test papers to prove she had been recently tested and tested negative (herpes was not listed on the testing papers).
Today I found out that the man she had a baby with 3 years ago has genital herpes. They have a baby together so I'm assuming she has them too. DH said there was nothing weird going on down stairs so he didn't think anything of it. So I'm assuming if she does have it, she didn't have an outbreak at the time.
What are the odds of him having it then? Can it be transferred even when she wasn't during an outbreak? We have no way of contacting her to ask if she is positive for them to be sure.
Your husband prob would have had an outbreak by now if he'd contracted them. One of my friends has been married to a girl with the herp for years now and hasn't gotten them. From what I understand, there really isn't a reliable test to tell if someone has the virus, so maybe that's why it wasn't on the papers.
Apparently she carries them with her. I applaud her for getting tested regularly but she KNEW her baby daddy has herpes and didn't inform my DH that there is a chance she could have had it as well.
