If you have custody of your kids but no restraining order against the father, he can come to the school anytime he wants to pick them up. As long as his name is on the birth certificate, the school can't stop him.

He can do this, however he would be found in contempt of court and then go to jail plain an simple.

Yes they can because he is no where posted as a legal guardian nor a person with permission to leave with my kid. He's such a good father that he doesn't even have a copy of the BC...

He's their father why shouldn't he be able to pick them up from school?

The school said it doesn't matter if he is on the no pick up. He is the biological father , they can't stop him. The school has record of the birth certificate.

Unless the custody order is on file with the school.

Good thing I trust my ex.  As long as he lets me know he is getting her I have no problem with him getting her from school.

If the visitation order is on it, he can still pick them up.

There are pick up lists for the school. If you aren't on the list and I haven't sent in a note they can't release my child.
