Recently my DH went to court again to modify the CO to include communication, visitation and CS terms.  He has custody of SD and visitation is up to his discretion because in the past BM has bailed, been too high or just plain abandoned SD.  That being said, he has NEVER kept SD from seeing BM so long as she was sober.

He was able to get the communication and visitation terms added but got lectured from the judge that he should give BM more time to get on her feet with regards to getting CS.  Ummm what? DHs lawyer was stunned and explained that it wasn't DHs job to ensure that BM was "ready" to pay CS for her own daughter.  It also wasn't DHs job to worry about BMs two new babies.  They went back and forth for a bit and then the judge ordered the lowest possible amount of CS, $50/month.

I guess I just don't understand why Bio-Dads are "deadbeats" when they don't pay and when Bio-Moms don't the BD's are supposed to take pity on them???

Do you think Non-custodial BMs should be expected to take care of the same responsibilities as Bio-Dads?

WOW

My ex was ordered to pay $45 a WEEK and he didn't even have a job.

That's pretty shitty of the judge

Hell yeah they should!!!

But I know how it goes, before DH got custody of SS's he was paying BM aprox $200/wk.

When DH got custody BM was ordered to pay $5/week which has now been upped to $20/week but she never pays anyway and is currently a year in arrears so it really doesn't matter.

But yeah it is one heck of a double standard!!!

I don't care, mother or father, the non-custodial parent should pay child support to the custodial parent.
