We owe our landlord over a grand and we are not paying it!

We rent a house for 1200/monthly. However we only paid 55 this month. This house is fucking horrible. When we rented, the owners assured us they were in the process to making repaires to the home and all would be done in no more than 3 months. However 6 months later, only 1/3 of the stuff needed to be done has been. So DH and I finally broke down and did it ourselfs. We hired a day laborer for the weekend and together the 3 of us did a few major repares. The repairs cost us 700ish in materials plus 60 dollars a day for the laborer and ourselves.

We included our receipts and attached a note as to why we had to detuct from our rent and that we will continue to with hold until he gets this house together. I know he will try to do everything in his power to evict us, but too bad cause we arent moveing until DS is finished with elementary.

he can easily evict you actually. Because you didn't follow the proper channels to withhold rent...

Good luck finding a new house with an eviction on your record.

I hope you made sure this is legal. People try that here and get evicted because its illegal to withhold rent.

Why not just find another house in the same school zone?

That's just not right. We've been more than patient and HE is the one who broke our agreement. He said all would be donein under 3 months, it's been 6. He doesn't even bother to answer our calls anymore. You with think after 80-100 calls and complains he would get the point we just are not going to tolerate this shit

Whoops! Looks like you just wasted a bunch of money on repairs that weren't authorized. Hopefully you and you're landlord can work this out, otherwise be prepared to be served eviction papers.

Btw- in an eviction they can remove you whether you want to or not. After a court approves the eviction and sets a lock out date, you will become an unlawful detainer (squater.). A sheriff will be present during you're lock out anyway so you'll leave.

It probably feels justified but it just doesn't work that way... Hope it works out for you.

There is a legal way to withhold rent, just not the way you did it. You should have done your research first before screwing with the roof over your head.
