I just found out my x got a lawyer when I filed for cs. My DS is almost 4 and we are just now going for cs. I can't afford a lawyer and legal aid in my state only does vpo cases. Can my x get custody if he has a lawyer and I don't?

No, it doesn't work that way but you should aways have representation when going to court. You would have to be deemed unfit to lose custody of your child.

Yes, he can get custody if he has an attorney and you don't. His attorney will work hard to make you  look unsuitable. 

However, because he has hired an attorney, you can hire one, and if you win, you can make him pay your attorney fees.

Please get a lawyer. Whoever has the lawyer tends to get things in their favor

Y should he be able to take my DS? He wanted nothing to do with DS until he was 2. His new wife wants me 100% out of the picture and the closest she can get is taking my DS. I have never has an issue with my x until he married and she convinced him she was a better mom and should raise my DS.

Your ex's new wife has ZERO say over any custody matter. You are not going to lose your child because your ex can afford an attorney. He has to prove you to be unfit. The most he could get is 50/50.
