Did I steal shoes?

My mom got a pair of sperry's for my daughter at one store. I opened them up and they were the boy's kind. My daughter wanted Sperry's, but she wanted the girls kind with a certain print on them. My mom is sensitive about this stuff and so I didn't mention it or ask her to return them. I went back to the store where she bought them to see if they had the kind my daughter wanted so I could do an exchange. No go. They didn't have em.

So, while I'm out, I to into another shop to look around. That store sells both the boys pair that I have and the girls pair that she wants. So I go out to the car, get the pair I have and tell them my mom got the wrong kind and I want to exchange them. There was maybe a $10 difference, so I paid the $10 and exchanged them at a different store from where they were purchased.

They were brand new--never worn, the box was intact, the stuffing was still in them, they could put them right back on the shelf and sell them for full price. So I say it wasn't stealing. The store isn't out anything. In fact, they're $10 richer than they were before.

My husband says it's stealing.

Whatcha think?

Technically it's iffy but if the store was fine with it you're good.

Nah, it's not like you returned them for cash so you could pocket it.

No since you paid the difference.

They have the "exchanged" merchandise and money? Not stealing.

I dont think you stole them. You exchanged them and paid the difference. They'll take the pair you gave them and sell them, so I think you're good.
