IDK my DD is in a highback booster with a harness. She  just turned 3, she's about 33-34 lbs and about 38 inches tall. Bump. I wouldn't take my DD out of a harness yet.

I would still be rear facing. But a 5 point harness at least!!! Lap and shoulder belts are more appropriate for a 5-6 year old. Rear face as long as your seat will allow and same with the forward facing harness. No need to rush , keeping your baby as safe as possible is the goal:)

High back boosters are for 40 lbs or more.

But is there anything legally prohibiting this or is it just better to still be in a car seat?

You do what works for you. Your child can legally be in a booster in most states. I'd look up your laws in your state to be sure.
The guidelines, I believe are now 4 and 40 to be in a booster.

I think the guideline is 40+ lbs. It depends on the make of the seat.

My 3 year old is 29 lbs and in a high backed booster BUT is 5 point harnessed. Just true belt I don't feel is safe enough at this age.
In car 2 he is in a regular 5 poibt harnessed seat. My stupid car is just tiny and won't accommodate a regular seat.
