When BF and his ex split, she bullied him into agreeing to giving her sole physical and legal custody, and him having visitation 1 hour every other day. HE filed a complaint saying this is what he wanted. They both signed it. The judge hadn't signed it tho. He said it was too vauge. BF's reasoning for why she should have sole physical and legal custody is "because she is the mother" 

That was months ago, and they never actually followed it. He hasn't even saw their child since the seperation.

Now, her lawyer is filing an agreeance to that (stating that she agrees with it all)

We don't want that anymore! We can't get a lawyer until we get taxes back, and by then the judge will already have decided.

Since he filed that that was what he wanted, what are the chances the judge will grant it? 

I think he fucked himself over...

Why would he want more when he hasn't even visited the kid since that happened?

Why on earth did he sign anything saying that he gave her all legal rights?  What a moron.  And don't even try to claim "she bullied him."  Unless she had a corkscrewaimed at his testicles, that isn't relevant.

No he didn't. He needs to speak to an atty. I understand you don't have enough for a retainer but do you have enough for a consult? You need to speak to someone asap.

So... he voluntarily gave away his child and hasn't exercised visitation in months?  The kid is probably better off without him.

Too late now. He should have been seeing his kid then. At least the time that he agreed to.

He didn't give away his child, he still has rights.
