Bm bought ds a new car seat. He is tall but skinny. He is also only 4 years old. She bought him a high back booster not 5 point harness. She also bought one for my bf. He is using it but I hate it.

Would you call the cops? Cps? Tell her off? Don't get me wrong. I never liked her parenting. I think she is too lax.

BM=mom, right?  If she has custody, leave it alone.  You are not his mom.

She says 46lbs but I doubt it.

Yes she has full custody

4 years old and 40lbs is the law. Neither cps or the police will do anything, she's well within her legal rights. He also may have maxed out on height for many boosters. I was trying to keep ds in a 5 point for as long as possible, but at his 5 year check-up the doctor told me it wasn't a good idea since he was so tall, I didn't even realize that there were height limitations too.

You really have no say in this matter.  You are not married to his father.  If you "Go off" on her, she will go to court to prevent you from having any contact with the child, and possibly limit the time his dad has with him.

 Depends on the laws for your state.  Here my kids were in boosters at 4yrs old pretty much the same things tall and skinny.  But I always went with my gut and state laws of were we lived for carseats.
