I AM GETTING NERVOUS...

 just have a feeling that BM is about to try and take us to court for custody... she has been spending ALOT of time just SD and her with her parents.. they are rich and are the kind of people who would pay for it..

The problem is that we are about to move... and in the CO it specifically says that Dh was given custody due to lack of support on BM's side.. well if she moves closer to her parents.. and we move away.. then she has more support, and her being the mom.. i feel like she might have a case for custody.. makes me SOO nervous!!

Why shouldn't she have her child? And it makes perfect sense that if you are moving away it's not her fault you're leaving and she shouldn't be penalized for it. And if that's the only reason he got custody than yes for sure she has a great case.

 She currently lives 3 hours away.. us moving makes it 4.. she is looking for a house a bit closer to her dad.. and its not the ONLY reason.. its just what was specified in the CO

 well if she is trying to do right by her child, I can't see the harm in at least 50/50. People have gotten custody back of their children for much worse reasoning.
