My brother was served today, and he's worried about a couple things. I have no clue about how child support works, so I thought I might be able to get some answers here.

The backstory here is, the child is 7. BM, and my brother broke up when the child was 2. They went to court, and 50/50 custody was ordered. There was no child support ordered at the time. Last year my brother was a dumbass, and got into drugs, and BM went for full custody. He moved back home, and she was granted full legal and physical custody in December.

So it hasn't been a year since custody changed, but the papers say. its been 33 months since the support order was last modified. Also that there may be arrearage owed. So does that mean back child support is going back 33 months? that doesn't make any sense cuz its only been 7 months since thecustody changed.

Also it says he has to appear, and if failure to appear a warrant will be authorized. He has a wife, and young child here to support, he can't afford to go there in person, can he petition for an over the phone hearing, or anything really that he can do?

The best advice I've got is that he needs to get a lawyer in that area well before the court date.  The lawyer can advise him on what to do next.

Contact a lawyer. Most give free consultations.

It shouldn't go back 33 months, it will go back to when she filed.  He needs to appear.
