Will I get in trouble?

About the 15th of Dec my sons friend brought some tires over here and put them under our carport. My son told him he could store them in the shed in the back yard and to put them there. Instead he put them under my carport. I have asked him to come get the tires or put them in the shed. He has not done either and keeps giving me excuses. Tonight he said he was in the next town over and had no gas to come get them.  Yet he had gas to come to town and meet my son and another friend. I told him if they were not gone tonight I was going to get rid of them. So Im going to load them up and take them and sell them tomorrow. I have facebook messages of me asking him several times to get the tires and of his excuses. If I sell them can I get in trouble?

Because he was told to put them there in the first place and did not. I have asked him several times to put them there. He can go run around town and be blocks from my house when he said he had no gas to get  here  yet cant run by and put them in the shed??

I'd sell them and consider it payment for storing them at my house.
