I am firing the girl because she wont stop talking about politics...

No it is not illegal*

She has been warned 5 times now and 5 is the final warning. The first one was for wearing a that point the owner sat her down and talked to her about how at work is NOT an appropriate place to be talking about politics. She seemed okay after that, until I found out she was doing it more secretly. I wanted to fire her just right then and there but the other managers decided to follow the procedure for "lesser" issues (I personally think directly defying me and the owner was a major offense that we could of fired her over but this could have been up to interpretation)  she has contiued to do it. 

I found out today a customer complained about something she said about a shirt they were wearing (it was political but really anything would have put her over the edge if she got a complaint) 

So tomorrow I am firing her. I dont really like firing people, it is never a good thing but for the first time I think this girl really really deserves it

I dont care what canidate you like or why, you dont do this kind of stuff at work.

Please do. It's a massive pain for the other coworkers. We had a lady like that during the last election. She ended up being terminated because she refused to adhere to the dress code, she was disruptive, and she was also harassing others regarding politics and voting for her candidate.

Unless one works at a PAC, it's inappropriate to discuss politics at work.

She is offending customers, she is getting complaints, why is it dumb to fire her?

I can see doing it if she is putting down others with different beliefs. That is why I hate Facebook around this time. I hate seeing people call each other names over differences and I hate seeing people "unfriend" others for having different beliefs. It gets to be ridiculous.
