If you have not filed papers of intent of divorce, then yes it is.

We've been legally separated over 3 years and both are dating someone else. The process is taking a long time. Are we just expected to wait??

Morally and religiously, yes.  If it's a state law question, most likely not unless you live in the bible belt.
